Terms of Service

1. Acceptance of Terms

By accessing or using Bounder ("the Service"), operated by Bounder Inc. ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Bounder is a SaaS platform that allows users to upload PDF documents and convert them into interactive, hosted flipbooks with analytics, sharing controls, and team collaboration features.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service.

4. Acceptable Use

You agree not to:

  • Upload content that infringes on intellectual property rights
  • Upload illegal, harmful, or offensive content
  • Attempt to gain unauthorized access to the Service or other accounts
  • Use the Service to distribute malware or spam
  • Reverse engineer or attempt to extract source code
  • Exceed rate limits or abuse API endpoints

5. Content Ownership

You retain all ownership rights to content you upload to Bounder. By uploading content, you grant us a limited license to process, store, and serve your content as necessary to provide the Service.

6. Billing and Payments

Paid plans are billed monthly via Stripe. You can cancel at any time and your plan will remain active until the end of the billing period. Refunds are handled on a case-by-case basis.

7. Data Handling and Deletion

We process and store your uploaded content solely to provide the Service. Upon account deletion or written request to haddadcole40@gmail.com, we will permanently delete your data, including uploaded PDFs, generated page images, analytics data, and account information, within 30 days. Aggregated, anonymized data that cannot be linked to your account may be retained for service improvement. For full details on data processing, see our Privacy Policy.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance when possible. We are not liable for downtime caused by factors outside our control, including internet outages, third-party service failures, or force majeure events. Current service status is available at our status page.

9. Intellectual Property and DMCA

All rights in the Service (excluding user content) are owned by Bounder Inc. You may not copy, modify, or distribute any part of the Service without written permission.

We respect intellectual property rights and will respond to valid takedown notices under the Digital Millennium Copyright Act (DMCA). To report infringing content hosted on Bounder, send a written notice to haddadcole40@gmail.com including: identification of the copyrighted work, the URL of the infringing flipbook, your contact information, and a statement of good faith belief that the use is unauthorized. We will remove or disable access to infringing content promptly upon receipt of a valid notice.

10. Termination

We reserve the right to suspend or terminate your account if you violate these terms, engage in abusive behavior, or fail to pay applicable fees. You may cancel your account at any time through the account settings. Upon termination, your access to the Service will cease and your data will be handled as described in Section 7.

11. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, Bounder Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Bounder Inc. and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these terms.

13. Dispute Resolution

Any disputes arising from these terms or your use of the Service shall first be addressed through good-faith negotiation by contacting us at haddadcole40@gmail.com. If a resolution cannot be reached within 30 days, disputes shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. These terms are governed by the laws of the State of Delaware, without regard to conflict of law provisions.

14. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or a prominent notice on the Service at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised terms. If you do not agree with the changes, you must stop using the Service and may request account deletion.
